    Hello,

    I worked for a US HQ company in their UK office for 4.5 years (2017 - 2021) in a leadership role. I’m in the process for a Director position (second line management) in their US office. As I am rejoining the company within 3 years, and spent 1+ years working outside the US, I’m hoping to secure an L1A visa.

    My question is - are you able to rejoin on an L1A visa, or do you need to be working for the company at time of application? I’m hearing mixed stories on this and would love some clarity. Ideally, I would start working once the visa has been approved and I’m based in the US.

    By definition, at the time of your interview you need to be have worked for 1 year (365 days) in last 3 years (1095 days) outside USA for same parent company. If you qualify for that, you should be fine.

    Second, its not a published rule to be working for same parent company at the time of application, but then how would you prove that you'll work for that company once the visa is approved.
