  • Work authorization with expiring L2s but active I94

Hi! I hope you are all doing great!

I'm a L1 visa holder and my wife has L2s. She is having some troubles getting a job because company HRs says that her visa expires in 4 months. But her I94 form expires in 2 years, because we received visa for 1 year and I94 for 3 years. What should we do in that case, do we need to renew the visa or is there any justification we can provide for work eligibility based on I94?

    Thanks for your time!

US visas are solely for entry, and have no relevance to one's stay inside the US. I'm not sure why her HR even knows when her visa expires, because she should not have needed to show them her visa at any point in her employment process.

This is my personal opinion and is not to be construed as legal advice.

Company asks about work authorization document, what should we show in that case?

        For the I-9, the L2S I-94 (which is a List C document) and state driver's license/state ID (a List B document).
