Can L2 visa holder apply work in USA if main applicant is not in US

Dear All,

As my husband got L1B and I have L2 visa approved. Can I apply and work in USA if my husband is still in India?

For L2 to be able to stay & work in USA, The primary L1 holder need to maintain his status.

By maintaining his status means his job is ON, he is getting paid & maintaining residence in USA.

If he is on a temporary visit outside USA, then you are fine. But he is moving out of USA on permanent basis (taking job elsewhere), then L2 will be void immediately.
