Lower tiers (Level 1 and Level 2) might be subject to lottery, while Level 3/4 are safe. Consulting companies paying much lower likely won't apply, and there's pressure for 3rd party workplaces to review H1b or LCA annually. Since consulting companies consume most visas and are unlikely to apply, there shouldn't be an issue at L2 wages. Companies have no incentive to not classify jobs as Level 1 or 2 in CS, and there are no other developerbook benefits to L3/4 beyond higher priority.
