  • Which visa for L2 Spouse when primary has EAD and can't file AOS

    Hi,

I am going to have a scenario.
Have I-485 AOS pending (date not current) and approved EAD+AP. I haven't started using EAD yet. When my AOS was filed (on date becoming current), my family was in India and their AOS could not be filed.
My L1 will max out next year and eventually I will have to switch on EAD and hence loosing out L1 status (hence family loosing L2 status).

In this case, on what VISA my family could live with me or what should be thee way forward?

    Thanks,

If your family can move to the US before your L1 status ends, they can come on L2 visas, and file I-485 as your derivative beneficiaries when they are here in the US. If they can't move before your L1 status ends, then you would need to file I-824 for them to do Consular Processing for immigrant visas, after your I-485 is approved.

This is my personal opinion and is not to be construed as legal advice.
