Iam currently working in US with a H1b status and plan to travel to India soon with my newborn baby taking long leave(of 5 months) with my US employer.
My husband is in India and getting his L1A processed through his company. There is an option where he can opt for my L2 to be processed along with his L1A .

- From India If i travel back to US in L2 status (so that i need not work for some time until iam able to manage my baby) can i still resume my H1b status by going back to india and coming back under H1b?
- Or will it be the case that once L2 is approved , i will completely loose the H1b status and will have no option but to travel with L2 status from India to US and resume my work in US only with L2 status ?
- Can my husband apply to convert from L1A to H4 EAD if i retain my h1b status , while he works with L1A status ? My H1b was approved last year and only recently iam trying to initiate PERM in the leadup to filing i140.
- Is it advisable for me to retain my H1b so that we both will not be dependant on the same employer (who processed my husband's L1) . Or is it ok for me to completely shift to L2 status considering its other benefits ?
