  • I 94 renewal

    Hi,

I recently entered US on L1 visa. My visa is valid till Oct'2013, but since my passport is expiring in Nov'2011, I got I-94 till that date. Is it possible to renew my I-94 without leaving US? My port of entry was chicago.

    You have three options

    1) Your employer will need to apply for the extension of status before the current I-94 expires. Extension of status can be filed 6 months in advance.

    2) After getting the passport renewed, you can try a local BCP post to see if they can extend your I-94 (In very rare cases, depending on the officer that you meet, it may work).

    3) Exit U.S (make sure you return all I-94's) and return back with the new passport and existing petition.

Thanks for your quick reply. I will check with my employer to see if they can apply for extension.

They should be able to do it. But they can't do it now. Extension can be filed only 6 months prior to I-94 expiry date. Get your passport renewed before filing the extension.
