  • Should I apply AOS while on L1B?

I am currently on an L1B visa with a validity of 2 years, and I have the option to extend it for another 2 years. However, my brother is a US citizen, and I am considering applying for Adjustment of Status (AOS) through family-based Green Card sponsorship. Should I proceed with the AOS application while I am currently on L1B and may require an extension after 2 years? Will applying for AOS now have any omeglz impact echat on the extension of my L1B visa?

You can only file AOS when a visa number is available for your category and priority date of your I-130 petition. Right now, the USCIS chart shows that AOS can only be filed for F4 (sibling) category petitions (I-130s) that were filed before March 2008 (or even longer ago if you were born in India, Mexico, or the Philippines). Did your brother file the I-130 before that date?

This is my personal opinion and is not to be construed as legal advice.
