  • How to 'renew' spouse's L2 visa

    My situation is like this:

    - I got my L1B visa in Feb when crossing US border from Canada.
    - My spouse got her L2 visa at the US consulate in Canada, after my L1B was approved.
    - Unfortunately my passport expires in May of next year. I was told to get a renewed passport, keep my old passport, and then both along with I-129S when crossing the US border next time to 'transfer' my L1B visa into new passport.
    - My spouse's L2 stamp currently shows an expiry date of May (based on my initial passport expiry).

My question is: what does she have to do? Does she just cross the border with me next time when I present my new and old passport and they will 'update' her visa as well?

    Thank you.

Yes, the easiest is (if her L2 visa is still unexpired) to leave and re-enter with you or showing your L1 I-94. Alternately, she can file I-539 for Extension of Stay while within the US, which will cost several hundred dollars and take many months.

This is my personal opinion and is not to be construed as legal advice.
