Hi ,
I am in same company for 9 years (worked in US from Oct 2015 to June 2019), went to home country(was manager there for > 1 year) and came back to USA on May 2022. I am on H1B currently.
My PERM will be filed in April ,2024 . I am maxing out 6 years on H1b in Dec,24. H1b VISA valid till Aug 1,2024. Recapture of 4 months pending.
1. Is it ok to apply for L1A COS from H1B to gain 1 more year. If L1A COS is rejected then what will happen to my current h1b.
2. Assuming I change to L1A and company continues with PERM + I140 approval and I get in Feb 25. Can I change back to H1B visa and continue after that on H1b.
3. If L1A is accepted how soon I can apply for I140 via EB1.
4. Assuming L1A gets approved what will happen after 7th year. Do i need to go back and have to attend lottery or can use approved I140 to continue here.
