Switching Visa from L1A to H1B - Can you still be in EB1 category?

Hi I'm on L1A and have applied for a green card - i140 pending for approval. My company is offering me to switch to H1B. They say my green card application category will remain EB1 and will not be impacted. Is that true? Will I still be in EB1 category? What's the risk of switching to H1B?

That is what my Attorneys also told me that EB1 can still be maintained which may be true as the criteria of EB1 Is independent of visa type.
