I am a L1 visa holder and my spouse has an L2S. Earlier this year we got our visa stamped in India and visa expiry date is 21 Jan 2027 while PED date is 25 Jan 2025. My petition then was valid till Jan 25,2025. On entry to US we got I94's valid till 25 Jan 2025. In October we filed the extensions for myself and dependents together. Then i upgraded my case to premium and it got approved in november and i got the approval notice with validity till 21 Jan 2027. My wife's extension is not approved yet. So we are thinking of her to exit US and re-enter to get her I94 updated. I have the following questions in this regard
1) Can my wife travel to India and re-enter US before 25 Jan 2025, and would she need visa stamping? Given that the passport has visa stamp valid till 21 Jan 2027, only the PED date is 25 Jan 2025.
2) Can she re-enter with an approval copy of my approved I797 which is valid till 21 Jan 2027? Do i need to accompany her or she can travel alone with my approval copy?
3) Since she will re-enter before 25 Jan 2025, which is the expiry of my previous petition, will she still get an updated I94 based on my new approved petition till 21 Jan 2027?
If anyone who has faced a similar situation and travelled without any hassle could comment that would really help. Also would request any help or comments from members on this topic.
