  • Attention Lawyer: seeking help on suing my employer

    Hello,
I am planning to sue my employer based on below ground-
My internal role was manager but they got me approved for L1B as software engineer for visa purposes.
My job description in L1B doesn't matches 80% of what I was doing.

    Planning to sue because -
1- they sent me termination notice because I was away from the country while on payroll , they did not even give me a warning.
2- if they can terminate my employment of this reason, I have all my right to sue them for another reason.

Please advise, I am ready to honor $$ for the best advice and help.

Hey, before you consult a lawyer, please read this. It's always better to get as much information about your situation as possible. I used skiplegal.ai to get this. Please note I am not a legal advisor.

The L1B visa is intended for specialized knowledge roles. If your internal job (manager) doesn’t align with the role stated in your L1B petition (software engineer), it could raise compliance issues. Employers are responsible for accurately representing your role to USCIS, and misrepresentation could be problematic.

Termination due to being abroad while on payroll depends on company policies and employment terms. If no warnings were given and policies weren’t followed, it could raise concerns about wrongful termination, especially if it contradicts your employment contract or the company’s standard procedures. (So please read your employment terms)
    • Consult an immigration attorney to evaluate any potential visa-related violations.
    • Seek advice from an employment lawyer to review your termination and assess whether you have grounds for a claim like wrongful termination or breach of contract.
    • Gather evidence, such as your job description, L1B petition, termination notice, and relevant communications, to support your case.
