  • Company responsibilities when an L1-B employment is terminated by the Company.

    Hi,

I have a few questions. I am on an L1-B visa and my employment has just been terminated due to a strategic shift in the Company’s focus. My questions are –

    1. Will the Company be legally bound to pay for the return fares for me and my dependents?
    2. By law, will they need to provide me any relocation charges?
    3. I would be forced to break my lease due to this development and thus would end up paying a penalty. Now as this is not a voluntary action, under California law, can this be exempted?

I ask this because if I have to pay for these (my airfare + relocation + lease) from my pocket, I will have no money left.

    Please advice.

The company may certainly be liable to pay your return ticket. (not dependents').
I don't know about the rest of the things. But you can ask for it from your HR. Since you can't pay for litigation, absorbing the cost after trying hard for it seems like your only option.
This is my opinion and not legal advice.
