L1B Rejection,Individual Petition Denial,What next ?

  • L1B Rejection,Individual Petition Denial,What next ?

    Everyone,
    I couldn't find much posts similar to my case. I had got L1B Blanket VISA rejection in Sept 2006, post which I applied for L1B Individual, I faced an RFE and Now I received a denial notice on I-129 Petition. Now, what next options do I have ?
    1. Can I appeal for remotion/reconsideration, How much time does it take ?
    2. Shall I apply for H1B Premium ? somewhere read it is best option.
    3. Is there a restriction i.e. min 6 months to wait before to re-apply for L1B or H1B ?
    Appreciate all answers, please help.

    You can apply for H1B Premium.
    May I know when you have applied for L1B Individual? and when your petition got rejected?

    Mine also in L1B Individual RFE status now.....

      So you'r suggesting I should go for H1B Premium, How much time does this take for process (average) ? and How about appeal for reconsider for L1 denial (Is it worth) ?

      I did one typo.. I got L1B Blanket rejection in Sept 2010 (mistakenly wrote 2006). Post which I had applied for L1B Individual-Premium in Oct'10 and got RFE in mid Jan'11. I responded back with RFE on Jan 31st and got denial on Feb 10th.

        L1b individual petition denial

        You can either reapply instead of appealing. If the denial reasons are just due or lack of professional packaging of your petition, then you could reapply instead of appealing because appealing takes time.

        Could you state the details of the REF from USCIS and somehow your response details to them.

        What is your position at your company at your home country and how long have you work with them and what supporting documents did your company gave to you to submit.

        Did you petition through an immigration lawyer

          I am in a similar situation, and you would know its a very bad position to be in ...what did you do afterwards? did you apply again for L1? if yes after how long...did it get approved?
