L2 VISA for my Husband, will it be a prob as he is holding B1 VISA

  • L2 VISA for my Husband, will it be a prob as he is holding B1 VISA

    Hi,

    I am currently holding L1 VISA, my hubby is also holding B1 VISA from same company as I Do as he was a colleague of mine. And also he traveled twice to US. Now he is working in different company. Now my question are

    1. will he have problems in US embassy bcoz of the B1 VISA he is holding.

    2. will it be a problem to bring husband as dependent compared to bringing Wife as dependent.

    3. Wat should my husband say when the embasy ppl ask, will u work after going to US, should he say yes or no? He has same job profile as mine so my worry if he says No they wont belive and if he says yes they wont allow. Help me in this.

    He can say 'Yes, after applying for EAD'

    Answers above. He cannot work without EAD approval after reaching the US.

      Hi,

      In case if the interviewer asks if my hubby is currently working, what can he say?

      If He says yes, doesn't it mean he is not dependent on me and would have more chances of getting visa rejected.

      please advise me.

        He will need to enter his present occupation on the form anyway.
        Such logic does not work. Don't worry, he will get the Visa. There are very few reasons why an L2 will be rejected.

          Hi All,

          Thanks for all your replies. My Husband went to VISA interview and he got L2 VISA.

          But the problem here is, I have my L1 VISA valid till jan end of 2012. Same with I-94 also. SO he got L2 VISA stamped only til Jan 2012, which is very valid.. He will Come to US in OCT. He is planning to H1 B VISA. can he go directly for the H1B oif he has to go for EAD.

          If he goes for EAD, by the time he gets his EAD his visa will expire.. He doesn't hold SSN also.

          Can someone help me..all we have is Oct, Nov, Dec time frame.

          Tell me process, like wat should i do?

            He can apply for EAD only after entering the US in L2 status.
            H1 can be filed any time by his employer, but if he is in the US at the time of filing, it can be done as change of status. H1 can be filed anytime as long annual cap remains open and change of status will be approved only if filed before his L2 I-94 expires. H1 may be approved for up to 3 years.

            He can only begin work after having approved EAD or approved change of status to H1. On H1 he must maintain status by working and getting paid.
