  • L1B to GC processing

    Hi,

I am currently in L1B since May 2007 and it is expiring in Nov 2011 (4.5 years). But I can extend it to another 6 more months ie. till May 2012 becoz we can stay for 5 years in L1B.

Now my employer is planning to file for my GC.I have few questions on this.

    1. Am I eligible for EB1 category?
    2. Do my employer needs to file for Labour if they file in EB2 or EB3 since I am already in L1B? I heard that if we are in L1B or L1A then we can directly file for I-140. Is this true?
    3. If they file directly for I-140 what would be my priority date? The date I entered the country in L1B or the date on which I-140 is filed?
    4. Will I be able to file for an L1B extension this September since my current L1B is expiring on Nov 2011?
    5. Or do I need to convert to H1B or L1A for GC processing?

Kindly help me out in this since I am little worried on my Visa status.
