Urgent - L1B visa is expired and I94 is still valid can i travel to india?

Hello,

my L1 visa is expired in Feb 2011 and my i 94 is still valid till Nov 2012.i have planned for india trip this sunday which is Mar 13.when i travel to india can i still be on US Payroll and go for fresh visa application in india?
i need to get response ASAP as i am travelling this sunday.please help

Keeping on US payroll is your companies decision so if they can allow you to work from home/remotely then that should not be issue. As a Indian IT companies philosophy if your client is fine with that and ready to bill you I don't see any problem. May be you can take unpaid leave if above not working out.

Related to VISA here are things to remember you will need to get new petition and then appear for interview in consulate which might take a month so just be aware of that.
