    Hi,

    My L1B visa and I-94 got expired on Nov-20-2010 and I have applied L1B extension on Sep-15-2010 i did not hear anything from USCIS still Feb-10-2011 my company filed under premium mode and i got RFE on Mar-03-2011.

    In this kind of situation my wife's due is April-14-2011 and my RFE reply date also the same. she is with me under L2.

    Please help me on following queries.

    1. Incase my RFE got denied how long i can stay in US?

    2. Once kid is born i can't leave the country without having passport and PIO card for my kid.

    3. Is it possible to process H1B through my company?

    4. Please suggest me the best option to stay back here

    I am in the critical situation please request anyone to help me on this

    Legally Immediately as your stay becomes illegal therafter

    2. Once kid is born i can't leave the country without having passport and PIO card for my kid.


    3. Is it possible to process H1B through my company?
    Yes. H1B and L1 extension can go in parallel. But a rejection in one may affect other. Suppose you first get H1B approval but later your L1 B extension gets denied and vice versa.

    4. Please suggest me the best option to stay back here
    Respond to RFE with proper information. I see many people getting approval after responding RFE. Since you have a bit critical situation, you should stay sometimes (at least 3-4 months after baby is born) in case of rejection. You have valid emergency reasons not to leave country. Stay cool, avoid having tension. Best of luck

          Need Help

          Hi all,

          I have a similar situation. Can you please suggest me what option I have. My RFE response will be submitted in by Jan 22 2012. My wife will be 32 weeks pregnant on March 1.

          How much time does USCIS take to respond to RFE?

          If I get a denial lets say by March end, then what are my options as my wife will not be in position to travel.
