L1A petition rejected and have L2

Hi,

I am in india. My company filed L1A. My petition got rejected. Now can i file L1B immediately.

If i file H1 in april and it get accepted, then can i travel to USA on that H1 or till october 2011 i cannot work with that H1 visa ?

Is it better to get H1 or get EAD based on L2. How much time will it take for getting EAD ?

Should i file it myself or keep an attorney for getting EAD faster ? Is there any premium processing for EAD ?

Are you and your spouse present in the US in L2 and L1 statuses respectively?
EAD can only be applied after arriving in the US in L2 status and not before. It will take 2-3 months for processing but you can work after it is approved.
For new H1 petition, you cannot work before Oct 1.

You can only apply for EAD after arriving in the US. Unfortunately there is no premium processing for EAD application.
