  • L1 A applied again

    My previous L1 A extension was denied stating i dont posess specalized knowledge . I applied for a new L1A again. I am still waiting for the results. My I94 has expired recently and my previous valid EAD has expired . My lawyer told me i can stay for 240 days legally in US . Can i and my wife still legally work in US.

    If my new L1 Visa is rejected how soon should i leave US, and would i go out of status Immediately

    Assuming the L1 petition was received by USCIS before your I-94 expired and it also accompanied I-539 to extend your wife's status, both of you are allowed to stay in the US and you are allowed to work for 240 days. Your wife is not allowed to work without having a valid EAD.

      thanks for the reply, but someone told me that i can only stay and not work as i go out of status since my I94 is not valid

        Check with a lawyer. The 240 day thing applies to H1 and I feel it will also apply to L1.
