  • L2 visa-need Canada visitor visa

    Hi,

I came to the US on L2 visa(valid till Dec '11 ). Recently i started working on H1 visa. I never went out of US after coming here, so i still have L2 visa stamping. Now i wanted to visit Canada, Do i need to have a H1 visa for coming back?
Please let me know if the L2 visa stamping is sufficient for the visit?

    Thanks in advance.

    SKD.

I assume your employer's H1 petition was approved with change of status meaning the approval notice had new I-94 at the bottom.
You have to attach this new I-94 to the previous L1 I-94 in your passport.
When you leave the US for Canada you should not submit any of these I-94's. If your trip is less than 30 days and you only visit Canada and no other country, then when you return, you will need to show these I-94's to the inspection officer and claim automatic visa revalidation. Read about it on CBP website.
If any of the above is not true, you will need to apply for an H1 visa at a US embassy/consulate.
You will also need Canada's visitor visa to enter Canada in any case.
This is my opinion and not legal advice.
