  • L1B expiry and I-94 extension

    My husband is on L1B in US. His visa is going to expire in August this year(2011). Recently his I-94 got extended which is valid till 2014. I already hold L2 visa and which will also expire in August this year(2011). Is it possible to re-apply L2 for me after August 2011?

    Please let me know the avenues if I have to travel to US after August 2011 given that my husband's L1 expires in August 2011 and just I-94 will be valid

    How I94 got extended?? Has re-entered US, if yes. Then you also shd have accompanied him. Now you have option to re-enter US, carry copy of his I94 and present it while you get new I94. That shd work. I'm not sure if there is any other option.

      Yes my husband re-entered US and his I-94 got extended due to that. My visa also expires in August 2011. So do you mean to say that if I have to travel to US after august, just the photo copy of my husband's I-94 is sufficient and not required to re-apply visa for me? I have a 10 months old baby and she does not have visa. How do I apply visa for her now?

        No, in current situation you cannot travel/stay beyond Aug 2011. You need to re-enter US before Aug 2011(early would be better) and then show copy of I-94. After Aug 2011 you cannot enter as your VISA will get expire so you are not eligible to reach to port of entry unless VISA is extended (which is also difficult in your situation as you are dependent VISA holder).

        @Baby, I assume its US citizen and has US passport, so you need to get POI card from Indian Counslate which takes time (i heard of it but not sure) then you all set to travel to India.

          My kid is not a US citizen. I heard that Visa can be re-applied for me based on my husband's I-94. But I'm not sure whether that is a correct information or not.

              Myself and my kid are in India. My Husband visited India recently and when he re-entered US his I-94 got extended. My husband's visa expires in August 2011. I have L2 visa and that will also expire in August 2011. My kid does not have a visa.

              I'm in a position wherein I can travel to US only after August 2011. I would like to know whether my L2 visa can be extended now?Also I have to apply fresh visa for my kid.

                Ok. Here is the thing, even if you apply new/fresh visa you will get validity till Aug 2011( as your visa (L2) validity == L1 visa validity and not I94 validity) only so that is not a option now. So you should apply L2 for your kid and once got stamped, fly to US with copy of I-94 of your husband which you need to present at port of entry.
                I would suggest to do these as soon as possible just avoid last minute hassel.

                Note: This is what I think and I know, may not be professional advise.

                  Posting as this may be useful for someone:

                  Me and my kid cannot apply visa/travel to US based on just the valid I-94 and expired visa. Only option left out is either my husband has to stay there in US or he has to come back to India and re-apply visa for him and then for us.

                    L1 is valid till Aug 2011. Right? so how can that be said as Expired?
                    Your Kid is fully eligible to apply for dependent Visa as primary L1 is still valid.
