  • documents required for RFE reply

I have applied for L2 and EAD concurrently, as change of status. I got my L2 approval notice and I94. But My EAD application was turned into RFE stating as follows.
"This office is unuable to verify the applicant's qualification for an employment authorization card. Pleae provide us with a copy of the principal L1 and applicant's Form I 94, passport, visa and I 129s approval notice or proof of eligibility for the benefit sought"

So am going to include the following documents in the reply . Can sumbody verify this is correct list ?
    1) Principal L1 :
    My wife's I 797
    2) Applicant's I94, passport:
My L2 visa's I94 , my passport pages.I am clear with this part.
    3) Applicant's visa and I129s:
My problem is that , since I have applied for change of status, I dont have L2 visa on my passport and also dont have I 129s.Should I include my old visa's documents ?

Please let me know If I have to include anything more on this ?

I have submitted the below items for my wife, and she got EAD.

    For L2 holder:
    Form I-765 with two photographs
    Check for the filing fee
Copy of new I-94 and L2 extension approval notice
Copy of passport with Visa (Visa was expired)
    Copy of old I-94
    Copy of Marriage certificate

    For L1 holder:
Copies of I-94 (old and new)
Copy of L1 extension approval notice (I 129)
Copy of Passport with Visa (Visa was expired)

    I 129 - is for the Principal L1 holder, not for L2.
L2 visa un-availablity is not a problem, since you have the L2 approval notice.
There is no harm in including your old visa documents as well.

      I797 is I129's approval notice.
      Marriage certificate is necessary.
This is my opinion and not legal advice.
