  • Can my new employer apply for L1B visa?

    Hi,

I got a question regarding applying for US work visa.

Following is the period of travel/visa:

    April 2006 - H1B approved (Employer A)
April 2007 - Stamping and travel to US
March 2008 - Returned to India
March 2009 - Travel to US
    Sept 2010 - Transferred H1B to L1B (Employer A)
Mar 2011 - Returned to India
    May 2011 - Quit/Left Employer A
    June 2011 - Joining Employer B

I believe, my stay duration in US is little less than 3 years. Since i am joining Employer B and I haven't stayed for complete 5 years on L1B visa...How will this be considered, when my new employer (Employer B) tries to apply for H1B or L1B visa?

Will i be eligible for another US visa or need to wait for an year before applying?

    Thanks for your help!

Can my new employer apply for L1B VISA?

    Hi,

I have a very basic question regarding L1B VISA.

I will be joining a new employer in the month of July'11. Can my employer file a L1B for me immediately or do I have to work with the employer for at least a year before I am eligible.

Also I have a valid B1 VISA but never traveled to US before. Does this help in any way.

    Thanks & Regards,
