My Son's I94 Out of Status (Passport renewed)
My Son's passport renewed last year Aug 2010 (holding L2 Valid Visa till Sep 2012). Few days back i noticed I-94 had the end date as old passport expiry date. Now he is in OUT OF STATUS. Went to CBP office for renewal, but CBP office asked to go out of country to get New I-94. I applied for Canadian visa but my kid's visa got refused because of I-94 expiration. I am kind of in locked situation.
Please advise on the below questions:
1) Can i try to travel to Mexico to get my I-94 (or) will I end up in the same situation?
2) If my family plans to go back to India, will they have any issue while surrendering my I-94 in the airport?
3) While US re-entry will there be any problem? What will be the impact?
4) What would Immigration Attorney would do as next step?
