Child's Passport Renewal (Expired L2 Visa but valid I-94)

Hello,

Please let me know if there will be any problem in my child's passport (Indian) renewal.

My status:
L1 Blanket Visa expired: 12/23/2010
Valid I-94 (during port of entry): 9/10/2013
Note: L1B extension wasn't applied since I had I-94 valid until 2013.

wife's status:
L2 visa expired: 12/23/2010
Valid I-94 (during port of entry): 11/10/2013

child's status:
L2 visa expired: 12/23/2010
Valid I-94 (during port of entry): 11/10/2013
passport expiry: 7/2/2011 (less than a month for expiry)

Please let me know if there will be any problem in renewing my child's passport with this status. If yes, please advice what should I do.
