L1 Expired but I-94 valid

  • L1 Expired but I-94 valid

    My L1B expires on 3rd Jan 2012, but the Expiry on my I-94 is 26-Oct-2013.
    I am currently in US (with my wife on L2) and would like to understand till when can I legally stay in US.

    Please help.

    Till your I-94 date.
    I assume your spouse's I-94 also expires with yours.

    Visa only needs to be valid on the day you travel to the US.

      Me and my wife came to US on different dates.
      My I-94 expires 26-Oct-13 but my wife's I-94 expires 03-Jan-12

      My wife is on L2. If I decide to stay beyond 03-Jan-12, will my wife be allowed to stay back with me?

        She will need to file I-539 to extend her status. This will need to be done before her I-94 expires. She should do it now, so that she will receive new extended I-94 before the current one expires. The form can be e-filed and supporting documents can be sent to the address that the system generates.
        She will need to attach copies of her I-94 (both sides), your I-94 (both sides), both of your passport data pages, your petition approval notice, both your visas, your last 6 month paystubs and a cover letter.
