Currently, me and my wife have L1 and L2 visa with respect to company X. We are still in India and plan to move to US in August.
Once there my wife will be applying for a EAD as well as looking for employers who can provide her H1B.
My question is:
1. Is there any problem in converting from L2 to H1B ? Does she need to come back to India to get it stamped to start working or can she start working from 1st October without coming back ?
2, In case I plan to change my visa from L1 to H1, Do I need to come back to India to make it effective ?
I recently heard that as per some new law (not able to find one), we need to come back to India to get the visa stamped through the counsular process. Can anyone confirm or deny that ?
Moreover, Can my company file for Green Card while I am on L1 ?
