  • L2 EAD extension

    Hi,

    My L1 Visa is expiring on 31-Mar-2012 and my I-94 on 30-June-2012. My wife is on L2 Visa and her I-94 is expiring on 31-Mar-2012. She has her L2 EAD which is expiring on 31-Jan-2012.

    Can I apply for her EAD extension without the extension of L1 and L2 visas?

    Please advise as my company might not process the visa extension until the end of the year.

    Since her I-94 is not according to your I-94, she needs to get it extended before it expires anyway. She should file I-539 to extend her I-94 and add I-765 for EAD in the same envelope. If she files I-765 only right now, EAD will not be issued beyond her I-94.
    As supporting documents she will need copies of both your I-94's (both sides), both your passports, your petition approval notice, your recent paystubs and a cover letter.
