  • L2 extension for dependent near 21st birthday

    Hi,

I have a question regarding visa L2 for a relative.

My sister in law is 20 years old now and she currently holds a L2 visa. She will become 21 years in Aug 12, 2011. She received a renewal on L2 visa at the beginning of the year and the notification states the visa L2 expires Jan 12, 2012.

She is currently in her home country and she expects to return to USA Aug 8, 2011 (4 days before her 21st birthday).

She has not yet gone to the caracas embassy to stamp her L2 renewal because there is uncertainty of the validity of the L2 visa, due to her 21 years approaching. The rest of the family got their L1/L2 visa stamped already in Caracas embassy.

    My questions are:

    1) Is the VISA L2 valid until Jan 12, 2012 or until the date she becomes 21 years old? if so, does she need to go to the embassy to get it stamped.

    2) Can she enter USA with her L2 visa in Aug 8, 2011 and having her stay extended until Jan 12, 2012 or will her stay be approved by the inmigration officer until the day she becomes 21 years old, meaning 4 days after she enters the country? will her entry be denied?

She also holds a European Comunity passport. If the L2 is no longer valid after her becomes 21 years old, can she enter USA with I-94W for 3 months while she gets all documents ready to aply for an student F1 visa?

    I appreciate your prompt response.

    Thanks & Regards,

    Marcial Vilchez
