  • Processing Time of L1/L2 VISA extension

    Hello,
    I have L1 VISA valid till 15 OCT 2011. I am travelling to USA on 22nd August with family ( they have also VISA valid till 15 OCT 2011 ). If I apply for the extension for myself and family, How much it takes to get the extension approvel?.If approval is pending till 15 OCT also, Can I stay in US till I get the approvel/rejection of extension?

    Your duration of stay is determined at the port of entry and is not necessarily same as Visa expiry. In case of L1 it depends on petition expiry, petition type (L1A, L1B, individual/blanket) etc. and previous stays in the US if any. You will be given an I-94 and you are allowed to stay until the date on that I-94. Your employer will need to file an extension before that I-94 expires. If the extension is pending while I-94 expires, you are allowed to stay in the US while it remains pending.

      In case my I94 and VISA expiry is same
      1) How much time, it takes to get L1/L2 extension approval?
      2) If my extension is not approved, how much time I will get to leave US?

        How do you know I-94 is the same if you haven't even traveled to the US? How do you even have an I-94?
        Anyway as already answered, your employer will need to file extension before I-94 expires. You are allowed to stay in the US even after I-94 expiry if extension is filed beforehand. Dependent's extension can be filed along with your extension. For normal processing it takes 2-3 months and 15 days with premium processing. If extension is denied, you must leave immediately (you are given 30 days from the date of denial before DHS starts removal proceedings).

          I have travelled US 4 times on L1 for short duation ( 6- 7 weeks ) and everytime I94 expiry was same as VISA expiry.

          Any idea what is the L2 VISA extension fee? My employer will not pay fee for my depednent's extension.

            The last I remember it was $340. You can check USCIS website for I-539 instructions.

              L2 visa extension process time...

              Hello Sir,

              My l2 visa has expired on 19th april 2014.i applied for extension on 7th april 2014 through my husbands company. Still i did not get extension.i checked in USCIS site it is showing still in the initial progress.i went to USCIS office also but they aRe also telling same thing it is still in the process.
              1.how many days can i stay in USA
              2. can i travel to India.
              3.May i know what is the process if i want to go India
              4.shall i drop this petition and re apply when i go to India..
              5.can i apply for ead...

              Could you Please clarify my doubts.. I am in full confusion.

                1. If your I-94 also expired on 19th April then the max you can stay, if USCIS doesnt take a decision on your extension request, is 240 Days from 19th April 2014.
                2. You can, but you would need to go for stamping in order to get a new visa, also avoid Europe route.
                3. Fill DS-160 online, book visa appointment and go for L2 visa interview.
                4. Your decision it doesnt matter.
                5. If your I-94 has expired you cannot apply for EAD till you get extension approved.
