    Hi,

    1. My husband L1B and my L2 visas are getting expired in sep 8, 2011. I hear many visas are getting rejected due to the current situation in US. If it is true, is there any other solution to stay here or can he apply for H1 ?
    2. I am on L2 EAD, searching for a job. As my visa expires, my EAD also gets expired. But I have I94 upto 2013. Can I still work based on I94 or I need my EAD renewed along with my Visa ???

    Any help you be appreciated.

    I'm on L1B and my wife on L2 . same applies to her....visa and EAD expires but have a valid I-94. Will she be able to work?

      You are allowed to stay in the US according to your I-94 date. Visa expiry does not matter.
      For working you need a valid EAD and that's why you need to apply well in advance before the current EAD expires.

        Thanks for the information.

        Yes, I knew that I can stay here upto my I94 date. But unless my visa is renewed, I cannot apply for EAD. And unless my husband Visa L1 is renewed, my visa L2 will not get renewed. So, is it true that many visas are rejected ?

        And if I get a job now, can I work after EAD expires for 3 months, as it takes 3 months to get a renewed EAD????

          That is not correct. Visa is only an entry document. One can apply for EAD while I-94 remains valid.

          AFAIK you cannot work after EAD expiry unless new EAD is issued. You can check with an experienced attorney.

            First of all visa and petition are two different things. Visa is just an entry document to U.S. When you are already in U.S, you don't need to have a valid visa to continue to stay and work. However, you need a valid I-94 associated with your current status. So to continue to stay and work, your spouse need a valid L1 petition and I-94 and you need a valid L2 petition and I-94. In order for you to to work, you need a valid EAD. You cannot work once the EAD gets expired. You can work only after renewing the EAD. That is why it is advisable to file the extension and EAD well before the current I-94 and EAD expires.

              Okay, so is it not required to have a valid visa to apply for EAD ? Bcoz my visa gets expired on
              sep 8, 2011, EAD expires on sep 8, 2011, I94 expires in 2013.
              So I can apply for EAD only after my visa renewed, isn't it ??? Once applied, it takes 90 days to get it. So what to do for this gap. If I get a job before it expired, can I continue???

                What part of the above replies do you not understand?
                Apply for EAD asap, get the visa only when you leave the US, both are not related.
                You cannot work after Sep 8 until you get new EAD.
