    Hello,
    I am on L2 visa and our visa expires on the 09 October 2011.I have to visit my home country where i plan to depart from US on the 6th of September and return back on the 4 Oct'11 to US.My visa and I94 Currently is valid until the 09 October 2011.My Husband is on L1-B visa and shall file his extension shortly.However he mentioned due to my travel arrangements he will file my extension for L2-b upon my return on the 5 Oct'11.Will there be any issues while doing so or should he file for my extension aswell along with his?Request guidance on how should we proceed.

    Since you are leaving U.S, there is no need to file the extension now. You can leave the country. Let your husband get his L1 extended. Then you travel back on a valid L2 visa and your husband's extended L1 petition, which will get you a new extended I-94 at the POE. You can stay in U.S as long as the I-94 remains valid. So there is no need to file the L2 extension immediately (You are allowed to file the extension only 6 months prior to the I-94 expiry date). It is not advisable to travel without your husband's extended petition. If you do that, you will have only 5 days on your I-94 (upon return) and any issues in filing the extension would put into illegal status.

      Thanks for the reply Shervin.However with your response we have few more questions below as follows-
      -Given the scenario that my husband's visa has extended while i am out of US,i would then need to carry the approved petition (approval notice) along with my current visa status having a expiry of 09 OCT'11 or will i have to visit US embassy in my home country to have my new visa stamped?
      -On the other hand if his visa is not extended can i still come back to US as my visa expiry date is on the 09 Oct'11?
      -Lastly in the scenario we have no update on extension/rejection of his visa in such a scenario how should we proceed with my travel?
