  • Filing for L1 (blanket) if I have an expired H1B

    Hi,

I'm currently employed with company A (for more than a year) and company A is in the process of filing blanket L1 petitions. I intend to use this opportunity to come to US on a L1B petition. However, I do hold a previous H1B visa which expired two years back (Sep 2009). The H1B petition (filed by company B) also has expired in April, 2011. Before the expiry of visa and petition I had returned back to my home country (in Jun 2009) while still being employed by a subsidiary of company B in my home country. Last year, company B (and all its subsidiaries) were acquired by Company A and I ended up as an employee of company A (in my home country, company A has presence in my home country).

In Feb 2011, company A filed for my B1/B2 visa and got it approved (for 10 years). I also traveled onsite for 10 weeks (March-Apr 2011) on this visa.

I would now like to use the L1 blanket petitions being filed by company A to enter USA on an L1B visa. Would my previous visa or employment history be cause for concern when applying for L1B ? Any help in this matter will be greatly appreciated.

You haven't violated anything and there should not be any issues as long as you qualify for L1 blanket.
