L1, l2 and EAD, and I94 for both expiring at the same time.

  • L1, l2 and EAD, and I94 for both expiring at the same time.

    Hi,
    I am on L1 and my I94 and L1 expires on mid march 12. My wife, on L2 and working on a valid EAD. Her L2, EAD and I94 all expires on the same day as that of mine (mid march 12).

    Now I have 2 options:

    1. Apply for my L1 (and hence L2)extension first ( which is allowed 6 months prior to expiry) in Sep and if I get extenstions by Dec, I will have enough time to apply for my wife's EAD renewal and she should get it by mid march.

    2. Apply for L1, L2 and her EAD all together by Mid Dec.

    In first option - If I dont get L1 and L2 extension by Dec, I may not have enough time to get my wife's EAD renewed by March. Assuming it takes 90 days to process.

    In 2nd process - I am not sure if this is a good option. If EAD processing starts before L1&L2 extension, they may reject it.

    Please let me know if there are any other better options, that I should persue. If she does not get her EAD my Mid March, she might have to leave the job ( is there any other way?).

    EAD application can be sent in the same packet as L2 extension application.

      I think, you are refering to the second option where I would send L1, L2 and EAD extention all in a single packet by Mid December. Is that Right? If yes, would there be any possibilities of EAD rejection if EAD processing start beofore L1 and L2?

        No, everything will be processed together. At worst L2 (I539) and EAD will be processed together.

          Refering to the same question as posted above. Can we apply for EAD and L2 Extension 6 months prior to Expiry?
