    Hi Experts,

    I am new to this forum, I would like to know your views in the below case.

    Last week my friend went to US and his L1-B visa is going to expire on 30-Dec-2011, at the port of entry everythig went smooth with the Immigration officer in US but he got the I-94 stamping same as his visa expiry date i.e. 30-Dec-2011.

    This is something strange as I have heard that normally I-94 is given for next 2 years in such cases.

    That depends on whether the petition is individual or blanket and how much time the person has spent in the US in L1 status in the past.
    His employer will need to file extension before his I-94 expires.

      Thanks for the info.

      In this case Its L1-B and he spent around 1 year before this trip.
      I talked to him and he said that he was asked whether your employer has filed an extension for you or not, He said, not yet.
      Now he planning to file an extension from US, what are chances of his extension getting approved since now a days L1-B is getting rejected very often.

      If I talk about my case I have an L1-B which is going to expire in Jan'2012 and I am in India now, can I file my extension from here itself, please advise.

        His employer can file extension max 6 months before I-94 expiry. One cannot say about chances, but it will not matter that his I-94 was shorter than expected.

        That depends on when your petition expires. In case of blanket there is no expiry date. Visa in your passport is only a travel document, you can use it to travel to US until it expires.

              Yes its a L1-Blanket petition and its gonna expire on 07-Jan-2012.

              Is it ok if I file it by Dec this year and can you tell me about its fee, is it same as filing a new L1- blanket visa?

                AFAIK blanket petitions have no expiry date. Visa and petition are different things.
                If his employer wants him to stay continuously in the US, extension can be filed up to 6 months before the I-94 expiry. It must be received by USCIS before I-94 expiry.
                If he leaves the US and if petition has no expiry date, all he has to do is to apply for Visa again and then travel to US. If petition has an expiry date, his employer will have to file an extension at any time.

                Petition filing fees are to be paid by the employer.
