Regarding L1B to L1A

Hello,

I am in L1b Visa. My visa is getting expired in December 2011 but i do have valid I-94 till 2013 May and my 5 year tenure will be completed in Dec 2013 if i stay that long.

1) Can i covert it from L1b to L1A without going to India? if so how long will it take through normal process or Premium?

2) Do i need to convert it before Dec 2011 or after any time? Or do i need to wait till 6 months before my I-94 expiration?

You don't need to go to India to convert to L1A you can file a conversion from here itself. The conversion can be filed no later than 6 mths from your max out. Better file premium

Could you please explain me about "max out" on your previous reply?

does "max out" refers 5 years tenure or my i -94 expiration ( 4 years 6 months)
