    Hi,

    My L1B extension is filed and today USCIS sent a notice for RFE. My VISA/I-94 are expiring on 08th Oct'11.
    1> In case the end result is not expected, i.e. 15th Oct'11 (anyday after my VISA/I-94 expiry date) USCIS is denying my L1B extension after receivign the response to RFE, is there any grace period to stay back here? Obviously it will not be for a long time, may be a few days!
    (OR)
    2> While my L1B extension is in progress, can I apply for new H1B with some other company?
    (OR)
    3> While my L1B extension is in progress, can I apply for new change of status from L1 to H4 (Because my spouse is having valid H1B petition)?

    Please advice.

    You are allowed to stay and work for the L1 employer while the extension petition remains pending.

    Yes, another employer can file H1. But if H1 is approved with change of status, you must start working for the H1 company. Your status depends on the last approved petition, you must maintain latest status by working for the corresponding employer.

    If H4 is approved, you will h ave to stop working.


    Please advice.
    Just wait for the L1 decision for now and continue working for the L1 employer. Don't complicate things by filing H4 or something.
