  • L1 to Multiple COS H1B -- Very Urgent Help Please

    Hi,

    I am currently working in reputed X company, and i am on L1B Visa From 3 Years,

    I am planning to convert my L1 B visa to H1 B visa through Y company, And i kept start date of the petition as JAN 2012, Due to Notice period in my current company.

    And the H1 B Petition from Y is still in processing [Premium, applied few days back, waiting for the result]

    Recently I gave interview for the FULL TIME Job with Z company, and i got selected for that, and they are ready to do H1 B Premium process, and they are ready to wait until my Notice period.

    Questions :

    1. Since I applied with Y company H1B, Can i still apply with Z company? Does it possible to apply Multiple H1b's through Different employers with Change of Status [L1 to H1B]

    2. due to notice period, i have to keep JAN 2012 as start of my petition date, can i give to Z company also same start date as i gave to Y company on H1 Petition.

    will appreciate if you answer these questions

    >>> Yes. It is not an issue. If both the H1B's get approved, you get to choose the employer. However, the effective dates of the H1B petitions plays an important role. Your status will change to H1B as per the 1st H1B petition that becomes effective and you cannot work for the L1 employer any longer. Let us say Y's petition becomes effective of Nov 1st and Z's petition gets effective from Dec 1st. Then you have to start working for Y as of Nov 1st and later on Dec 1st, you can either continue for Y or move to Z.

    >>> It is better to do that. Otherwise you will face the issue mentioned above. If both the H1B petitions get approved and the effective dates of the both the petitions are Jan 1st 2012, then you can join one of these employers.
