If you are currently in U.S, then the employer will need to file a change of status from L1B to H1B. When the COS gets approved (it should come with a new I-94 attached to the approval notice), your status will chage to H1B and you can start working. Visa is only an entry document to U.S. You need to get the H1B visa stamped only when you leave U.S and want to re-enter in H1B status. There will be no questions for converting from L1Bto H1B. It is not a crime to file a COS. If so, they won't have that option at the first place. The H1B visa interview questions will be case by case basis and they will most probably be about your employer, work and your qualification.
