  • Pls advice- L1B-expiring, I-94- extension- Need to travel

    Hi folks,

I hv travel planned to India during Jan2012, bt my VISA and I-94 is xpring on Dec2011. My company has filed for my VISA xtension(n i might get to knw status of this xtension in a month as application is wth USCIS)
Can some1 pls help me advice on below:

    1) If i get my I94 xtended(while i m in US) n then travel to India during Jan2012, how likely it is to get VISA stamped during Feb2012??
    2) While returnign to US, If ever i didnt get VISA stamped, what would be the reason that would cause this?
    3) what is RFE over L1B xtension cases? (assuming i hv al valid docs from my employer, wht other things can cause my VISA stamping to be rejected?)
    4) If ever my stamping gets rejected/hold, n i m stuck in India, what should i do(apply for new L1B or what best should i do??)?
    5) Kepping above facts in mind(VISA/I94 xperning on Dec2011) should i take risk of travel to India during Feb2012??

Please do suggest, if ever i get I94 xtended, should i travel to India during Feb2012 n take risk for VISA stamping during Feb2012(wht is the current trend) are there too many L1B xtension rejection cases too??

    Please advice, need to plan

    Thanks much in advance!!

    Remember the following things.
Your employer must file for I-94 extension before it expires. You are not allowed to stay past the I-94 date unless extension is pending.
Whenever you leave the US and want to return, you need a valid visa.

L1 petition will receive normal scrutiny. There is nothing you can do to avoid that.

L1 Visa is rejected, if the consular officer is not convinced about your employer and whether the job is qualified for that visa or not. They will also check your credentials and experience. Having extension petition approved never guarantees visa approval. That is a risk you have to take. There is no workaround for that.

Also, how difficult is it to type 'ex'?
This is my opinion and not legal advice.
