  • I-94 extension for a valid L1 Visa status

    Hi,

    My L1 visa is valid till Feb 2013. But when i entered US, my passport was valid only till 3rd Dec 2011...so i was issued with an I-94 only till 3rd Dec 2011.

    I have got my new passport issued in US itself. So now, i have a valid passport till 2021, L1 visa till Feb 2013. My only issue is with I-94...

    Now, should i get my I-94 extended? If so, how should i do that?
    Please advice.

    2 ways.
    Your employer can file to extend it or you can leave the US and return.

      you said 2 ways...

      employer should extend it - whether this will go like VISA extension process I mean like submitting i129s and other stuffs, because many gets RFE now a days when going for extension, here in this case though we have valid visa why are they going for visa extension process.

      If I'm wrong please let us know what employer will do for this case?

      Even I'm having similar condition like this like Balaji...

        There is no such thing as Visa extension. Extension of status (I-94) is mistakenly called as Visa extension and that's what you need. Since you have a valid Visa and valid petition, easiest way for you is to leave the US and return. You can do this by visiting Canada or Mexico as well.
