Apply for L2 visa after getting 221g on H1 visa

Hello,

Can someone advise me on this topic based on your knowledge or prior experience? Any information is appreciated.

My wife got a 221g. Her H1 visa interview was on Sep 19 2011. She provided all the documents to the consulate on the same day. But its been a month now and we have not heard back from the consulate. Fortunately the consulate didn't take her passport at the time of the interview.

I have a L1 visa and I am in US currently. Can my wife apply for a L2 visa given the situation above (i.e. while her 221g is being processed)? Or do we need to withdraw the H1 visa (not sure how this is done) and then apply for L2? Will the 221g cause any problems in L2 processing?

No issues. The 221g on H1B will not impact the L2 stamping. Both H1B and L2 applications will be processes independently. So you don't have to withdraw the H1B application.
