  • L1A extension denied, visa expired end of april

    Hi everyone,
I have a situation here. I would much appreciate any help at all.
My company applied for my L1A visa extension back in February 2011 because the expiration date of my visa was April 30, 2011. Since applying for my extension back in February, USCIS has sent the company 2 RFEs and my company has sent them everything that they had requested. Finally the second RFE which they sent for me came back with a denial letter, so now my L1A visa extension is denied.
I was wondering when do I need to leave the country?? I don't want to stay here with no status and become illegal. Please keep in mind my visa expired April 30, 2011 and since April till now, my case has been pending due to 2 RFEs.

Visa is just an entry document to U.S. You don't need a valid visa to stay and work in U.S. When you are inside U.S, your I-94 determines your valid presence in the country. When did your I-94 expire? Any time spend in U.S after the I-94 expiry date will be considered as illegal stay. If your I-94 has laready expired, then you should leave the country immediately to avoid accumulating more illegal stay.

My i94 also expired on April 30, 2011.
I read some where that from the date of the denial letter, people get 180 days to leave the country. Is this true?

That is not true. If the petition gets denied, then all the time spend in U.S after the I-94 expiry date will be treated as illegal stay and it will cause issues during your future petitions, visa processing and GC process. If you stay illegally for more than 180 days you will get a 3 year ban from entering U.S. If you stay illegally for more than 1 year, you will get an automatic 10 year ban.
