  • B1/B2 to L2 question

My husband's company is transferring him to the US next year. I am currently pregnant and my due date happens to be a couple of weeks after the start date of his new position. He won't be able to get his L1 visa until close to his actual start date, by which time I wouldn't be able to travel since I will be very pregnant by then. I have a valid B1/B2 visa. How feasible is it for me to enter the US on B1/2 and file for a change of status to L-2 after he gets to the US next year ? I would rather not stay behind to have the baby on my own.

Every visa has it's own purpose. Entering U.S in B2 not for the purpose of tourism is illegal. Also, the officer at the POE might feel that you are entering U.S for the purpose of child birth. IN such case, they will deny your entry to U.S and will ask you to return back. Also, child birth in U.S is a very expensive business. How are you going to show insurance? You cannot get personal insurance when you are pregnant.
It won't get approved. And what if the COS from B1/B2 to L2 didn't get approved by USCIS? Will you stay illegaly in the country as B1/B2 allows you to sat not more than 6 months in a stretch.

It is advisable to get the L1/L2 early and travel together or stay back and travel after the child birth. Do consult your case with an immigration attorney.
