L1 and spouse working on EAD

Hello All,

I am on L1 and my spouse is working on EAD, which she got with L2 status. I would like to know the below:

1. Can she continue to work on EAD till the validity of EAD if I do COS from L1 to H1.
2. Can she continue to work on EAD in US until EAD expires if i go back to India, to the same employer whom i have L1.

Please suggest.

No. She will have to change to H4 and then she cannot use EAD.
2. Can she continue to work on EAD in US until EAD expires if i go back to India, to the same employer whom i have L1.
No, in that case she cannot even stay in the US. Only if you leave the US for short duration with full intention to return in L1 status can your dependents stay.

L2 status is dependent on you maintaining your L1 status. If youa are not in L1 status, then there is no L2 for your dependents. If you change your status to H1B or leave the country, you will no longer hold the L1 staus and so your dependents will go out of status on L2 (if their immigration status has not already changed).

My L1 extension will be in Sep 2012. I am on L1 Blanket visa and can i apply for extension while I am in US like L1 individual cases or do i need to go back to India for extension as mine is blanket type. I know when I leave for home country and i have to go for visa stamping before entering US.
