Once, I get my new L1B Canada Visa, my wife's old L2 visa will remain valid or not

  • Once, I get my new L1B Canada Visa, my wife's old L2 visa will remain valid or not

    Hi,

    I have a situation and I want some suggestions.

    My L1B Visa is valid till 15 Jan 2012 (same is in I-94). My wife got her L2 visa recently based on my visa and she will be coming on 4th Dec to USA.

    Now, my new L1B Canada visa was initiated and I have to appear for personnel interview in Canada on 15th Nov. So, my question is, once I get my new L1B Visa from Canada, my wife's L2 Visa will remain valid or not?
    Will she have any problem in getting here because by 4th Dec I'll be having new L1B Visa and my wife will have L2 visa based on my older L1B Visa?

    Please advise.

    Your L1 visa has nothing to do with your wife's L2 visa. She can enter U.S as long as you are in L1 status and she has a valid L2 visa and your latest L1 petition. By showing your latest L1 approval notice, she can get a matching I-94 expiry date.

        Query regarding L1B stamping in Canada.

        Hi,

        I have my L1Blanket visa expiring on Nov 2012. I94 has an expiry date of March 2015, which makes me ineligible to apply for extension of the existing petition. I have to travel to India in December 2012 for personal reasons.
        My company is suggesting to initiate a new L1 Blanket and get it stamped from Canada. I have a few queries regarding stamping of L1 in Canada -

        1. On the first hand, can i apply and go for stamping for a new L1 when my current L1 is still active ?
        2. Is there any risk of rejection for L1 petitions in Canada?
        3. Worst case, if my application gets rejected in Canada, will i be able to come back to US with my current Visa.

          >>> Why not? Irrespective of where you apply, there is always the risk of rejection.

          3. Worst case, if my application gets rejected in Canada, will i be able to come back to US with my current Visa.
          >>> The first thing that they will do is cancel the curent visa before approving or rejecting you the new visa. If your visa stamping gets rejected, then the chances or returning back is very less. There is very very slight chance that they will let the previous L1 visa in the passport without cancelling it. In such a case, you can return back. You still need a valid petition when you return back.

                First time stamping in Canada - EVC Model

                Hi!

                I want to get my H1B stamped from Canada. This is my first ever stamping and I am on EVC model. I have a Masters degree from the US.
                Is it a good idea to go to Canada and get it stamped? Can anyone share their experience/ do's and dont's with me?
                If the visa gets rejected, can I come back here on a H4 since my husband has a valid H1?

                  Hi Sachin,

                  As she already has valid L2 visa till Jan 2012, I don't think any issue with traveling, the only thing they might ask is how long you are going to stay and her I94 is valid till her visa expiry date and once she is in the US you can apply for her visa baised on your New L1.

                  for safer side, once you get the visa you can send a copy of your new visa, and petition so that she can provide those document when they ask for your status.

                  Those who are travel for work (on L1, H1 visa) some times they check wether you have valid visa for atleast 6 months from that date but i have seen people even entered in US having valid visa for 2- 4 months so for depentend i don't think any issue.
