  • L2 in US, can work for Home Country Payroll company remotely

    Hi,
    I have an L2.
Currently I am in Home country employed. Can I go to US and still continue to work for Home Country company remotely till I get my EAD status.
If my current employer agrees to it or is there any violation of US Law.

You need to get EAD before working

As far as I know once you enter US on L2 you cannot receive any income from any ongoing work (worldwide) until such time as you receive proper employment authorization from USCIS. You can surely remain on the payroll without getting paid such a Leave Without Pay etc This my opinion please do seek expert advice too before deciding.

But if the salary is being paid in Home Country - Home Currency, does it violate any rule?

I guess L2 visa status provides opportunity to work in USA for US firm but it's not Mandatory to work for?

In my case, I don't want to quit my current employment in home country and at the same time contiune living with my spouse in US (L1 visa holder). Which visa i should apply for?

          L2 is dependent visa

Hello, as far as I know L2 visa is a dependent visa and for legally working in US (irrespective of whether you are working for a company outside US) you would need to apply for EAD after coming to US on L2. You can come to US on L2, apply for EAD and then work for the Indian company. This is my opinion it would be best if you speak to immigration experts for greater details.
