  • L2 EAD to H1-B

    I am working on L2 EAD since last 6 months and now want to apply for fresh H1-B , my work order for the current project is only till next 4 months with a possibility of extension.

    Will I get H1-B for min 2-3 years based on this documentation or not ???
    I had earlier H1-B and B1 approvals. But now I want to apply fresh H1-B

    Please suggest and thanks for your suggestions.

    It depends on your employer's business model and how long they can prove to have work for you. If the employer does not have any other business than sending people to work for other companies, it is possible that H1 petition will be approved for 4 months or 1 year only. If USCIS is satisfied that your employer has work for you for 3 years, they will approve the employer's H1 petition for 3 years.
